The case is unusual because it's actually the child's mother who tries to vacate the court's order against the first father.&lt;br /&gt;&lt;br /&gt;The case emphasizes again the huge stakes of acknowledging you're the father without DNA testing. If you're wrong and you don't get into court within 60 days you're likely stuck. Well, the statute says...&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-style: italic;"&gt;"&lt;/span&gt;&lt;code style="font-family: arial; font-style: italic;"&gt;Family or household members" include spouses, former spouses, parents, children, stepchildren and , persons who share or formerly shared a common dwelling, persons who have or allegedly have a child in common, persons who share or allegedly share a blood relationship through a child, persons who have or have had a dating or engagement relationship, persons with disabilities and their personal assistants, and caregivers as defined in paragraph (3) of subsection (b) of Section 12‑21 of the Criminal Code of 1961."&lt;/code&gt;&lt;code style="font-family: arial;"&gt;&lt;/code&gt;&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;That's what was at issue in a recent 4th District Appellate case, &lt;a href="http://64.233.167.104/search?q=cache:aQ7ulDqjTpQJ:state.il.us/court/Opinions/AppellateCourt/2008/4thDistrict/February/4070079.pdf+Benjamin+v.+McKinnon+IL+Appellate+Court&amp;amp;hl=en&amp;amp;ct=clnk&amp;amp;cd=1&amp;amp;gl=us"&gt;&lt;span&gt;&lt;/span&gt;&lt;/a&gt;&lt;span&gt;&lt;a title="http://eservices.isba.org/12all/lt/t_go.php?i=1382&amp;amp;e=MzE1NDI1OQ==&amp;amp;l=-http--www.state.il.us/court/Opinions/AppellateCourt/2008/4thDistrict/February/4070079.pdf"&gt;Benjamin  v. McKinnon&lt;/a&gt;, No. 4-07-0079&lt;/span&gt;.  The facts were fairly typical, Plaintiff was alleging various verbal and physical abuse against two Defendants. What was a bit unusual was that the two Defendants were a FORMER father-in-law and brother-in-law...i.e. the Plaintiff was FORMERLY married to the Defendants brother/son.  So do those two people fit within the above definition? The piece discussed the alleged increasing role of a parent's religious choice as a factor in how judges decide custody cases. That loan had been guaranteed by the former wife's father.  So ex-husband fails to make payments on the loan and the lender goes after the father.  Father pays off the loan in a lump-sum payment...done.  Now, several years later the ex-wife now tries to enforce the judgment against the ex-husband for his failure to pay the loan. &lt;br /&gt;&lt;br /&gt;Nope...denied for lack of standing.  It's like this, typically when you're alleging that someone is not following a court's judgment you are asking a court to find that person in &lt;em&gt;contempt of court&lt;/em&gt;.  The only punishment for this "contempt" can be to force someone to act...the most common scenario is for a person to be jailed for not paying child support and then there's a bond of say 10% of the support due so the person jailed has to make some partial payment on his back support to get out of jail. &lt;br /&gt;&lt;br /&gt;The problem with the ex-wife here? Randolph w/ Judge Reynolds.  Darn I had a case there the other day...I must have missed the fun. Here's a nugget from the article:&lt;br /&gt;&lt;br /&gt;&lt;em&gt;Mary Virginia Barry, 84, weighed only 70 pounds when paramedics found her in April in a cluttered bedroom, lying on soiled sheets with ants crawling on her, in the Geneva house she shared with two daughters.&lt;/em&gt;&lt;br /&gt;&lt;em&gt;&lt;/em&gt;&lt;br /&gt;&lt;em&gt;Barry, suffering from cancer and the aftermath of a stroke several years ago, died of pneumonia days later on April 27, and autopsy photos showed her vertebrae visible through numerous bedsores. I.e...big tax consequences. &lt;br /&gt;&lt;br /&gt;If alimony is part of a divorce judgment it has to be clearly defined as such:&lt;br /&gt;&lt;br /&gt;--Must be paid pursuant to a divorce or separation agreement;&lt;br /&gt;--Parties must live in separate households;&lt;br /&gt;--Payments must be designated to end when the recipient dies;&lt;br /&gt;&lt;br /&gt;A recent case dealt with the big question above (&lt;a href="http://docs.cpamerica.org/wtu/proctor.pdf"&gt;Proctor v. IRS&lt;/a&gt;).  The former husband in a divorce had been ordered to pay part of his disposable pension payments to his former wife as a "property settlement."  This payment was not in any way said to &lt;u&gt;NOT be alimony&lt;/u&gt;. &lt;br /&gt;&lt;br /&gt;Well, the husband tries to claim these payments as tax deductible alimony and guess what, the tax court agreed!  A nice little tax burden to the former wife. &lt;br /&gt;&lt;br /&gt;My general thoughts are that alimony/maintenance must be defined very clearly because you have both the family law issues but then there are also the tax issues.  Further, it's tricky when a person has a pension that's already in payment status. (QUINN) Affirmed Mother's petition to restrict the visitation of the father, alleging disrupting conduct on the part of the father in the presence of the children, was sufficient, despite failure to attach affidavit in compliance with local Circuit Rules, since it contained 1-109 certification. Further, father has failed to establish that trial court abused its discretion when it ordered supervised visitation, with the father required to pay for the supervision, since he failed to include a transcript of the hearing in his report of proceedings. &lt;/em&gt;&lt;br /&gt;&lt;br /&gt;Take a read of the full case. The piece suggest SSDI appeals are taking some 3 years to process.&lt;br /&gt;&lt;br /&gt;&lt;em&gt;Of the roughly 2.5 million disability applicants each year now, about two-thirds are turned down initially by state agencies, which make decisions with federal oversight based on paper records but no face-to-face interview. Winyard&lt;/a&gt; regarding an Alienation of Affections suit.  This sort of suit is where a former spouse sues a person for tempting her/his former spouse to have an affair and if successful is awarded monetary damages.  The plaintiff was divorced from her husband in 2003 and brought the Alienation of Affections case in 2005.  However, the defendant had filed for bankruptcy in 2001.  The trial court dismissed the case saying that this liability was discharged as part of the bankruptcy.  It's interesting because if the trial court said this type of case were an intentional tort this would NOT have been dischargeable.  Strange because as a lawyer I surely consider this type of case a tort. &lt;br /&gt;&lt;br /&gt;The second as was &lt;a href="http://www.state.il.us/court/Opinions/AppellateCourt/2007/2ndDistrict/October/2061048.pdf"&gt;In re Marriage of Rife&lt;/a&gt;.  This one's almost funny.  Here the marital settlement agreement said that the mother's right to receive child support would be terminated if she tried to modify visitation, child support or custody. It's always important to consider a cause of action against an employer.  Often the employer has the $$. &lt;br /&gt;&lt;br /&gt;We often use Notices of Withholding (NOW) with large employers.  But think about using these with small businesses or self-employed people too (small corps and the like).  I have a case right now where it would have been nice if the previous attorney had used a NOW with this small corporation that the father/obligor runs. November 5, 2007 lead editorial&lt;/a&gt;:&lt;br /&gt;&lt;br /&gt;What a disappointing position from the Tribune...essentially, because adultery is not uncommon our public policy should therefore not discourage it.&lt;br /&gt;&lt;br /&gt;An important purpose of our civil litigation system, and specifically tort cases (such as alienation of affections), is to discourage certain types of behavior. Torts are not criminal behavior, so I suppose it is correct to say that people are "legally entitled to do" such acts. But, they are civil "wrongs" that we want to discourage...like doctors who screw up during surgery or the person who drives through the front door of my home.&lt;br /&gt;&lt;br /&gt;I think marriage is something to be encouraged and a person's conduct that undermines marriage should be punishable. With the elimination of "fault" in the Illinois Marriage and Dissolution of Marriage Act, the alienation of affections cause of action is the only punishment that is left. The tone of the Editorial, "courts...starting" to hand out these financial awards is misleading. This type of action has been around for hundreds if not thousands of years. Also, success in this sort of case is rare I think due primarily to judges allowing personal views to cloud their jurisprudence.&lt;br /&gt;&lt;br /&gt;We should encourage greater use of the Alienation of Affection cause of action. Crank&lt;/a&gt;.  The case essentially deals with the issue of whether there are limits on how much a court can order to be paid toward past due child support or maintenance arrearages. He actually was attempting to appeal this "freeze."  Why?  Allegedly his name was simply placed on his mother's account to help her with bill paying, ect.  &lt;u&gt;Don't do this!!&lt;/u&gt;  It's a long shot that he'll be successful in fighting this. &lt;br /&gt;&lt;br /&gt;The first lesson I suppose is don't get behind in child support payments.  BUT, if you do get behind (and it does happen sometimes) keep your savings where IDHFS can't find them. The attorney for the mother brought a petition for support alleging that the girl was disabled based on the allegation that she had ADHD. &lt;br /&gt;&lt;br /&gt;I said that's crap ADHD is not a disability that allows support pursuant to Section 513 of the Marriage and Dissolution of Marriage Act.  Eventually the opposing party backed down realizing they'd have to bring in some high priced experts to testify to the daughters disability.  We came to an Agreed Order regarding college expenses. &lt;br /&gt;&lt;br /&gt;The problem for the mother in this case was that the father had not been ordered to contribute to tuition prior to the daughter turning 19. The tip is to name the custodial parent as the beneficiary on the life insurance on the other parent's life.  I think more often than not Marital Settlement Agreements will name the respective parent as "trustee for xyz child."  Naming the parent directly allows for easier access to funds and that's the intention of the life insurance anyways.  Also, perhaps add a 30/60 deadline to do this and show proof...attorneys follow-up on this. Take a read...seemingly the issue was basically about a non-custodial father wanting more visitation.&lt;br /&gt;&lt;br /&gt;&lt;em&gt;The dispute apparently revolved around Gitchel (father) wanting further visitation with his daughter, police said.&lt;/em&gt;&lt;br /&gt;&lt;em&gt;&lt;/em&gt;&lt;br /&gt;What to do in this situation?  Well, if you're the non-custodial parent I'd recommend having a certified copy of the court's visitation order with you at your pick-up time.  Calling the police is an option because visitation abuse &lt;u&gt;IS&lt;/u&gt; a criminal violation...however it should be a last resort. Section 505(g-5) of Income Withholding for Support Act does not limit the amount that can be withheld from obligor's wages, for payment of support and maintenance arrearage &lt;u&gt;after&lt;/u&gt; emancipation of children to the amount that had been withheld for current support before emancipation.  Pursuant to federal Consumer Credit Protection Act, incorporated in Illinois Income Withholding for Support Act, maximum withholding for support and maintenance is &lt;u&gt;50% of obligor's wages if he or she has a dependent spouse or child, and 60% of ogligor's wages if not&lt;/u&gt;. Get a divorce." The billboard featured photos of a scantily clad woman and a shirtless man and was an ad for Chicago divorce attorney &lt;a href="http://www.fgalawfirm.com/index.html"&gt;Corri Fetman&lt;/a&gt;.&lt;br /&gt;&lt;br /&gt;As someone who practices a good bit of family law, I've never seen nor heard of Ms. Fetman. Sadly I see this perspective as the majority view of family law practitioners. I disagree with it personally. I'm in the field because I think family break-up is tragic and also because it places people and their children in a very vulnerable position. I think I can bring some effective advocacy and a little light to these dark situations. Why?&lt;br /&gt;&lt;br /&gt;Because of the HUGE post-divorce ways that you can screw-up your life.  Two things I see, one all the time and a new one from this week. &lt;br /&gt;&lt;br /&gt;First, child support obligors who don't understand how child support works.  They fail to stop the support in the event of a job loss or an income decrease and next thing you know they're 20,000 behind in child support payments. &lt;br /&gt;&lt;br /&gt;Second, saw this one up close this week, it was a mother who frankly didn't understand mediation.  Long story short is that she refused to attend mediation with her former husband as was required  by the joint parenting agreement.  One thing she did was send her son to another country without the approval of the father and she refused to mediate the issue.  She ended up getting held in contempt of court and paying the father's attorneys fees. &lt;br /&gt;&lt;br /&gt;A judgment for dissolution of marriage is a document with staying power...sometimes for 20+ years.  It's not a one time thing get it entered and done. Often what makes these doubley tough is that lawyers haven't been involved too much and the clients may be confused about procedures.  &lt;br /&gt;&lt;br /&gt;I have a tough one right now where my client was getting charged for child support in IL continuously for the entire time that the child lived with the mother.  IL support was never stopped.  Meanwhile, the mother moves to MN and applies for public aid up there.  So MN support starts to run against the father, our client.  Recently, custody of the son gets changed to our client.  Now the problem is that both IL and MN are trying to collect on arrearages for overlapping times.  Adding to the frustration is that for one of the periods MN is trying to collect, the child had actually been with the father.  We may be able to wipe that period out by providing MN w/ proof the child's school records in another state. &lt;br /&gt;&lt;br /&gt;Pretty interesting situation though. We filed a petition to terminate support when the child turned 18 because he'd dropped out of school but the mother kept coming into court trying to show that the child was still in school.  Eventually we subpoenaed a GED provider and they said the kid was out of the program so we got support stopped effective at the child's 18th birthday. &lt;br /&gt;&lt;br /&gt;Remember when child support stops...I think there are a lot of misperceptions out there.  It stops at one of four possible times:&lt;br /&gt;&lt;br /&gt;&lt;u&gt;A)  Child turns 18&lt;/u&gt;.  This was my case above.  If you have a child NOT attending high school it stops when he/she turns 18.&lt;br /&gt;&lt;br /&gt;&lt;u&gt;B)  Child graduates high school&lt;/u&gt;.  This is likely the most popular option.  Most kids graduate high school during their 18th year; support should terminate at the same time the child graduates high school.&lt;br /&gt;&lt;br /&gt;&lt;u&gt;C)  Child turns 19&lt;/u&gt;.  If a child is still in school when he/she turns 19, support should time at the 19th birthday. &lt;br /&gt;&lt;br /&gt;&lt;u&gt;D)  Child is emancipated&lt;/u&gt;.  This is rare but I do hear it come up every so often.  This situation is when a child essentially would be self-sustaining or married prior to his/her 18th birthday. Essentially it's a mortgage brokerage that focuses on helping single parents and recent divorcees. &lt;br /&gt;&lt;br /&gt;The bigger issue I think is that people don't change their lifestyles &lt;u&gt;enough&lt;/u&gt; post-divorce.  In many situations, the parties' income has just been cut in half and yet people often think they can live in the same home and neighborhood, ect. I'm not a bankruptcy expert.  I typically consult another attorney or two when I have these cases just to make sure I'm doing everything right.  I think in the future it might be wise to even co-counsel with another attorney who's a pure bankruptcy lawyer. &lt;br /&gt;&lt;br /&gt;All that to mention a horrible experience we're having that mostly stems from the fact that our Cook County Domestic Relations judge didn't know her bankruptcy law and she gave us a totally unworkable judgment.  She essentially didn't know that before a marital residence got sold that the parties' Chapter 13 plan would have to be paid off.  She thought that we could just sell the marital residence and split the proceeds and then my client could just keep paying the Chapter 13 plan all-the-while. And it always goes back to this basic fact about one's child support obligation, &lt;u&gt;your child support obligation DOES NOT STOP UNLESS YOU GET INTO COURT TO STOP IT!!&lt;/u&gt; It does not get lowered unless you get into court to lower it! And I'm always getting these, usually father's, coming in either after they've been put in jail for contempt of court or they're some $30,000 in the whole on back child support. And my sad answer in 99% of cases is that I can't do anything about the back child support. Once child support hasn't been paid for 30 days, it becomes a Judgment against that person and Peter the Lawyer nor the judges in these cases can do anything about it.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;So gang, let's be smart, if you become unemployed or you have an income drop, get into court and modify your child support downward. If you're someone who pays child support through the &lt;a href="http://www.hfs.illinois.gov/"&gt;IL Dept. of Healthcare and Family Services&lt;/a&gt;...LOOK OUT!&lt;br /&gt;&lt;br /&gt;This just happened to our client:&lt;br /&gt;&lt;br /&gt;We represented a gentleman in some matters related to modifying child support. Judge enters an order that says client must pay X in current support and Y towards an arrearage. It's right there in a court order. Now, some 2 months later, client's employer gets a Notice of Withholding from IDHFS that is inconsistent with the court order...&lt;u&gt;OF COURSE IT'S HIGHER&lt;/u&gt;. If I did this as a lawyer, I think I could lose my law license. But since it's this big state bureaucracy, they're almost bullet-proof. The piece includes appropriate admonishment of lawyers to not take sides in a divorce. And also to control your client...don't go along with what he says.&lt;br /&gt;&lt;br /&gt;The crux of piece focuses on important issues of IL family law...i.e. that we're a so-called No Fault state. If you've lived separate and apart from your spouse for two years, you can get divorced without any other reason. Also, conduct is not supposed to be considered regarding custody unless the conduct somehow effected the child.&lt;br /&gt;&lt;br /&gt;Remember (from the article)...&lt;br /&gt;&lt;br /&gt;&lt;em&gt;The moral issue is often, if not usually, of great significance to the "innocent" party. This is understandable, and you should acknowledge your client's feelings. The Judeo-Christian tradition is that wrongs are punished. Often the client feels robbed of closure because his or her ex is not punished.&lt;br /&gt;&lt;/em&gt;&lt;br /&gt;&lt;em&gt;But Illinois law is a no-fault state. We lawyers should not lose our objectivity by over-identifying with the client. Doing so only magnifies any unrealistic expectations the client has about the outcome.&lt;/em&gt;&lt;br /&gt;&lt;em&gt;&lt;/em&gt;&lt;br /&gt;As an aside, there's nothing more wasteful and upsetting than an opposing attorney/client who's out of control or who's expectations haven't been "shaped" by a competent attorney. One went for me and one against. &lt;u&gt;The issue&lt;/u&gt;: did a court have jurisdiction over the party in a case originally so that it was proper for the court to rule on anything, such as child support?&lt;br /&gt;&lt;br /&gt;The two cases I've dealt with recently were alleged back child support cases and in both cases, the father's have successfully found deficient service of process to get out of thousands and hundreds of thousands of dollars in back child support. &lt;strong&gt;If you're working with some one accused of not paying child support, look back at the entire court file to see if things were done right up front.&lt;/strong&gt; It's a method to totally get out of alleged back child support OR to negotiate a low settlement figure. I'm in a position now to vacate a divorce judgment from 1985 because there wasn't good service of process up front. &lt;u&gt;The opposing client may find herself married to my client all over again when she thought she got divorced 22 years ago!!&lt;/u&gt;&lt;br /&gt;&lt;br /&gt;Remember, there are only three ways a court can obtain jursidiction to order someone to pay child support:&lt;br /&gt;&lt;br /&gt;1. Service of Summons by the Sheriff or private process server;&lt;br /&gt;&lt;br /&gt;2. Filing of a voluntary Appearance;&lt;br /&gt;&lt;br /&gt;3. Here's part of the statue:&lt;br /&gt;&lt;br /&gt;&lt;em&gt;Sec. 513. Support for Non‑minor Children and Educational Expenses.     (a) The court may award sums of money out of the property and income of either or both parties or the estate of a deceased parent, as equity may require, for the support of the child or children of the parties who have attained majority in the following instances:        &lt;br /&gt;&lt;br /&gt;(1) When the child is &lt;u&gt;mentally or physically disabled&lt;/u&gt; and not otherwise emancipated, an application for support may be made before or after the child has attained majority.&lt;/em&gt;&lt;br /&gt;&lt;em&gt;&lt;/em&gt;&lt;br /&gt;The big question is, what is "disabled"?  The mother in this case is saying that the daughter is disabled with ADHD and some mild depression.
